Help with provisional pat. app.?
I have every thing ready to go and am ready to do the actual app.but I have no idea what one looks like. I have reg. pat. downloads but you can’t download a provisional as you know if you know what I’m talking about.
Anyway……….An out line or other “sample” would be a good starter or if you know of a site on the USPTO that would show an example that would work.. I’ve spent untold hours on the site over the past year and haven’t found anything like that.
Maybe this is a stretch but what the hey!

There is no formal application form for this. (http://inventors.about.com/od/provisionalpatent/a/Provisional_Pat.htm) Actually there is no such thing as a provisional patent. Instead you will be creating a provisional application for a patent. This costs less and allows you up to one year to decide to file for a formal patent and do a rigorous search. Basically, you will be staking a claim that you intend to file a formal patent application at a later date. But you will only be protected to this right for one year.

The application itself should read similar to normal patent. Read up on the links, but in general you don’t have to be as thorough about your references or searches. Also, the provisional application cannot be converted to a non-provisional patent. You will have to file the patent claim at a later date. It does have advantages and disadvantages. Please read the links that I found to be very useful.
The USPTO site clearly states what is or what is not required for the provisional application for a patent. As I mentioned already, it’s basically a simplified patent claim that ‘buys’ you time to do a more formal and complete claim. Do keep in mind that there is more overall cost to do the provisional application and then the formal patent application. However, properly executed it can add up to 12 months to the standard 20 year patent protection period. It really depends on what is right for your circumstances.
